The overarching objective of this work is to advise government on the design of a model lease designed for letting land so that it can be used (wholly or partly) for an environmental purpose.
It is likely the drafting of a model lease would be a fairly straightforward technical legal exercise, and while the outputs of this work (see below) will include a model Heads of Terms and model clauses, this is only part of the focus.
Of equal importance is to ensure that the lease:
- is relevant to the needs and ambitions of potential users
- provides a practical tool to facilitate taking control of land for environmental purposes
- provides a flexible and robust option that has the confidence of landlords and tenants
- will be used by a wide range of stakeholders
- clearly achieves stakeholder support, consensus, and buy in
Identifying use cases and opportunities will be a key objective, ensuring the lease is designed in a way that can accommodate a wide range of potential scenarios.
Identifying key barriers to the use of a model lease is also an important objective, and where possible, indicating where policy and/or legislative change would be required.
