The Scottish Government require external legal advice to cover the implementation of the Developer Remediation Contract (DRC) and general legal work related to the Cladding Remediation Programme including advice, litigation and dispute resolution assistance related to both developer-led buildings and other buildings in scope of the Cladding Remediation Programme, as follows:• Legal advice on the Developer Remediation Contract.• Any continued drafting work on the Developer Remediation Contract and associated documents.• Advice on any continued negotiations with Homes for Scotland and developers, and associated correspondence.• Attendance at negotiation meetings with Homes for Scotland and developers, and any associated meetings and correspondence.• Advice on Notices and Warrants issued in connection with the Housing (Cladding Remediation) (Scotland) Act 2024.• Advice and assistance on public and/or developer responses to Developer Remediation Contract.• Advice on Dispute Resolution mechanism under the DRC.• Advice and representation on legal issues relating to both the DRC and the wider Cladding Remediation Programme, including dispute resolution, litigation, and appeals.• Advice on the scope and interpretation of the Housing (Cladding Remediation) (Scotland) Act 2024, including advice relating to the enactment of secondary legislation in connection with Ministers powers as conferred by the Act, advice relating to the publication of statutory standards for building assessment (as provided for at s. 32 of the Act) advice relating to the production of statutory or other guidance or any such documentation as Scottish Ministers may choose to publish.• Advice and support on the Responsible Developer Scheme.• Any other cladding related legal services as required.
