The water mains pipes in the vicinity of the new Woodlands Lane roundabout are the property of utility contractor Portsmouth Water. In order to facilitate the new development, these pipes must be diverted and that is only possible using Portsmouth Water and Their appointed contractor.

The reasoning for this waiver to be granted is under (iv) "execution of works or provision of services of a specialised nature which can only be carried out by one contractor (where no reasonable alternative or substitute exists)" as Portsmouth Water own the property of the water pipes that are required to be diverted, there is no other contractor who would be entitled to carry out the required diversion works.
