description

The Defence Equipment & Support Land Equipment Vehicle Support Team, part of the UK Ministry of Defence, intends to award a Contract to Boughton Engineering Limited, for a period of three years with a further 1-year option, for the provision of technical advisory support to the Armoured Vehicle, Royal Engineer (AVRE) Trailer. The contract is anticipated to commence in July 2023 and will have an estimated total value of £398k (Ex VAT) including the option year.

In accordance with Regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this contract falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of this contract without prior publication of a contract notice in the UK e-notification service (as required by the relevant legislation) is lawful in accordance with Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 due to technical reasons

Boughton Engineering Limited is the Design Authority for and the Original Equipment Manufacturer of the AVRE Trailer and has maintained and supported the AVRE Trailer since it came into service in 1996. As such, Broughton Engineering Limited is the only company with access to the technical information, expertise and know-how necessary to provide technical advice and services and input to the Safety Environmental Management Panels in order to assure the safety of the equipment. If a third party was to carry out this work, it would add an unacceptable level of risk to the management of the equipment. Broughton Engineering Limited have confirmed that they are unwilling to sell the technical data pack and rights to either MOD or a third party, and without this information it is not possible for another supplier to provide the required level of support to assure the safe use of the equipment

Additional Information: The Authority is enacting a 10 day standstill day from the point of publication of this notice, which shall end on Monday the 3rd of July at 16:00. This notice is not a request for expressions of interest so please do not apply to be invited to tender. This notice advises that the Authority has decided to negotiate a contract with the named supplier on a single source basis and is published for reasons of transparency. If you are interested in becoming a sub-contractor for this requirement, you should apply directly to the supplier named above.
