Modification notice for the original contract. We are uplifting the value in the original contract, under Public Sector Regulations 72e, which states:

72.-(1) Contracts and framework agreements may be modified without a new procurement procedure in accordance with this Part in any of the following cases:-

[e] (a)the modification renders the contract or the framework agreement materially different in character from the one initially concluded; The modification will not render the contract or the framework agreement materially different in character from the one initially concluded as it is only to uplift the value in-line with the original contract. All original contract scope and character will remain materially the same.

(b)the modification introduces conditions which, had they been part of the initial procurement procedure, would have-

(i)allowed for the admission of other candidates than those initially selected. The contract was procured via a CCS framework, and all suppliers on the framework were invited to bid as part of the initial procurement procedure. The modification will retain the same scope of the original contract, and the department wishes to uplift the value in-line with the original contract. The modification does not introduce any conditions to affect the acceptance of tenders other than that originally accepted.

(iii)attracted additional participants in the procurement procedure; The contract was procured via a CCS framework, and all suppliers on the framework were invited to bid as part of the initial procurement procedure. Same scope and the department wishes to uplift the value in-line with the original contract. This modification does not introduce any conditions to affect attracting additional participants in the procurement procedure.

(c)the modification changes the economic balance of the contract or the framework agreement in favour of the contractor in a manner which was not provided for in the initial contract or framework agreement; The modification will not change the economic balance of the contract or framework agreement in favour of the contractor which was not provided for in the initial contract. The modification will retain the same scope of the original contract, and the department wishes to uplift the value in-line with the original contract.

(d)the modification extends the scope of the contract or framework agreement considerably; The modification does not extend the scope of the contract or framework agreement considerably. The modification will remain in the same scope, and the department wishes to uplift the value in-line with the original contract.

(e)a new contractor replaces the one to which the contracting authority had initially awarded the contract in cases other than those provided for in paragraph (1)(d). The modification will not replace the initial contractor with a new contractor initially awarded the contract.
