Many of the highway improvement projects undertaken by Peterborough City Council (acting in its capacity as local highway authority) require some form of utility diversion works to be undertaken. This may be due to the fact that the carriageway or footway alignment is being changed, the road geometry is to be altered or topographical levels are having to be adjusted.

The process for dealing with utility diversions is prescribed in the New Roads and Street Works Act (NRSWA) 1991 and consists of notification to the Statutory Undertakers via a number of dedicated stages, direct engagement with them, the production of estimates for diversion works and the mechanism by which payments are made. The council has a statutory duty to follow this process on all highway related projects.

The Lincoln Road Improvements Project is one of a number of projects that is part funded by the Towns Fund. In order to undertake the improvement works City Fibre apparatus requires diverting. Therefore an exemption is sought to make an advanced payment to City Fibre apparatus to enable the main highway works to proceed for the scheme planned.
