This notice is for transparency purposes only.
A company which has a Decommissioning Relief Deed (DRD) is making a series of claims, the supplier will; -
| 1 | Advise the Authority on all aspects of whether the company has a valid claim under the terms of its DRD with the Authority; |
| 2 | Review any claim made by the company, identifying key legal issues which need to be resolved, including input into whether decommissioning expenditure has been properly incurred and input into the requirements relating to avoidance; |
| 3 | Develop a project plan for providing appropriate advice to the required timetable - the timetable is difficult to predict because it is determined by the terms of the DRD, starting at the time when a claim is actually made, and also dependent on whether the company include all of the necessary information with the claim form. However, the Authority would expect to see a provisional timetable indicating how the supplier will meet the prescribed timetable and for this timetable to be adjusted when any claim is actually received; |
| 4 | Prepare any paperwork necessary for the Authority to consider the validity of the company's claim; |
| 5 | Identify any areas where additional information is necessary or where there are outstanding questions which require answers from the company before a decision on the |
| 6 | Draft any correspondence between the Authority and the company relating to assessing the validity of any claim by the company; and |
| 7 | Provide a final report for the Authority providing detailed assessment of the validity of the company's claim. |
