Provision of Technical Support for SEND Procurement

Tenders are invited for the provision of technical support for the procurement project for the Delivery of the Smart Energy Network Demonstrator (SEND). The SEND works procurement is to appoint a contractor to carry out both the design and construction elements of the SEND project under a single-stage design and build contract. It has an estimated value of £7 million.

The University is conducting the SEND works procurement using the Competitive Procedure with Negotiation in accordance with regulation 29 of the Public Contracts Regulations 2015 (PCRs). The form of contract that the University intends to enter into with the Contractor for the SEND works contract will based on FIDIC Silver Book First Edition 1999 as will be amended in accordance with the University's preferred contractual position.

The SEND project is part funded from the European Regional Development Fund (ERDF) as part of the European Structural and Investment Funds England Growth Programme 2014-2020 and the Department for Business, Energy and Industrial Strategy (BEIS). The technical support required for the SEND works procurement is also part funded by ERDF.

Tenderers remain responsible for all costs and expenses incurred by them or by any third party acting under instructions from the Tenderer in connection with taking part in this procurement, regardless of whether such costs arise as a direct or indirect consequence of any amendments made to the procurement documents by the University at any time.

Under no circumstances will the University or any of its respective advisors be liable for any costs or expenses (including, but not limited to: loss of profits, depletion of goodwill, loss of anticipated savings or any special, indirect, consequential or pure economic loss, costs, damages, charges and expenses ("Losses")) incurred by Tenderers, funders and/or its respective advisors arising directly or indirectly from this procurement or termination thereof, or any changes or adjustments including, without limitation any changes or adjustments made to the procurement documentation, or the exclusion/disqualification of a Tenderer.

For the avoidance of doubt, where a Tenderer withdraws, is disqualified or is excluded from the procurement process, under no circumstances will the University or its advisors be liable for any Losses howsoever incurred by such Tenderers.
