ARFQ - The Provision of Securing Works under Section 29 of the Local Government (Misc. Provisions) Act 1982 and Stabilisation Works under Sections 77 or 78 of the Building Act 1984

Under Section 29 of the Local Government (Miscellaneous Provisions) Act 1982, the Authority is responsible for ensuring that buildings which become both ‘vacant and insecure’ are re-secured against entry. The owners of the buildings are initially requested to carry out the work themselves but if this does not happen then the Authority are authorised to make arrangements to carry out the necessary work themselves (via a contractor).

The costs for carrying out these works are met by the Authority who in turn will recover the costs from the owner.

In a similar way, under Sections 77 or 78 of the Building Act 1984, the Authority is also responsible for ensuring that any structurally unstable buildings (or structures) are made safe by way of either stabilization or demolition. Again the owners of the buildings (or structures) are encouraged to carry out the works themselves but if this does not happen then the Authority are authorised to make arrangements to carry out the necessary work themselves (via a contractor).

Again, the costs for carrying out these works are met by the Authority who in turn will recover the costs from the owner.
