In 2005 the Parliament passed the Mental Capacity Act (MCA). Under this legislation, Surrey County Council has a statutory responsibility to commission Independent Mental Capacity Advocacy (IMCA) services as required and as such, is seeking a third party to provide these services to people living in Surrey.

The Relevant Authority must or may make arrangements under sections 35 - 41 of the Mental Capacity Act 2005 to enable the appointment of Independent Mental Capacity Advocates (IMCA), to be available to represent and support people to whom acts or decisions under sections 37, 38 and 39 of the Act relate or who meet the requirements under the Mental Capacity Act 2005 (Independent Mental Capacity Advocates) (Expansion Of Role) Regulations 2006 (Si 2006/2883)
