NHS Resolution seeks to gain an understanding of the capacity and appetite to bid on The Provision of a Legal Panel Services Framework.
The providers should have sufficient scale and expertise to manage anything from group litigation to claims brought by litigants in person against NHS Trusts and/or GP's and other ALBs on the framework including NHS England and NHS Improvement
NHS Resolution will follow this market engagement exercise by conducting an Open OJEU Tender in order to establish a multi-Lot Framework for the Provision of a Legal Panel Services.
Providers will have to demonstrate they can add value to the services we deliver to our members and support us in delivering learning from litigation. We require innovative pricing models to incentivise the right behaviours in meeting our strategic objectives, whilst delivering value for money to the taxpayer.
Providers will be expected to work with other function areas of our organisation and are encouraged to make themselves familiar with the whole of our organisation.
The Framework Agreement will be for a term of 36 months a break clause in year two.
NHS Resolution is currently considering using lots for this procurement, however it reserves the right to change any aspect of the lot structure or not use lots as part of any future tender.
There are potentially three lots on the framework.
Lot 1-Clinical Negligence claims
Lot 2-Non Clinical Negligence claims (employers/public liability, property, Human Rights Act, Data Protection Act claims)
Lot 3-Regulatory, Health and Employment Law (other forms of litigation related to the operation of ALBS including judicial reviews, procurement challenges, commercial litigation and advisory work across a broad range of contentious and non contentious legal specialisms including public law, healthcare advisory/regulatory, primary care advisory, property and estates)
The Market Engagement will take place on the 4th August 2020 at 9am. The Event will be conducted online Via Microsoft Teams.

We will be sending a full Information pack prior to the event.
NHS Resolution is seeking to advertise this opportunity in September 2020. With a view to awarding the contract by the end of January 2021.

This includes but is not limited to advertising and fair treatment of economic operators regardless of their involvement in this Market Engagement.
