Ofwat has a legal duty to implement the new market rules and licences. The objective of this requirement is to support Ofwat with a number of key aspects of the delivery of the Open Water programme which are necessary to achieve the successful opening of the non-household retail water and sewerage market in April 2017.

Scope

The latest version of the integrated market opening plan for the non-household retail market sets out the activities that need to be undertaken between now and 31 March 2017 to enable the non-household retail market to open to competition on 1 April 2017. This plan also sets out the key deliverables associated with these activities and the timescales for the activities and deliverables.

The plan shows deliverables to be carried out by a combination of Defra, Ofwat, Open Water Markets Ltd (OWML) and companies already in the industry or seeking to enter the market.

Many of the activities in the plan are shown as to be carried out by OWML. However, in the light of its being designated as part of the public sector, it was decided that OWML would be wound down and the delivery of the market architecture transferred on 1st June 2015. Most of its activities and deliverables will be transferred to Market Operator Services Limited (MOSL), a private company which is expected to become the market operator. However, some activities will be transferred to Ofwat, and we are seeking a Delivery Partner to assist in their delivery.

In addition, we seek a Delivery Partner to support Ofwat in the delivery of its own activities as shown in the plan. Most of these activities are associated with company licences, and require legal and policy input.

We have identified 5 high level tasks which need to be completed within the work of the Delivery Partner:

a)The new Water and Sewerage Supply Licence (WSSL)
b)The existing (appointee) licence
c)Work to support the development of the Interim Codes Panel
d)Exit / Supplier of Last Resort (SoLR) / Supplier of First Resort (SoFR)
e)Statutory consultation on market documents
