Adult Community Health Services in Cornwall and Isles of Scilly which will include but not limited to the following services:

Some of these services require provision to Children. This is detailed below:

Physiotherapy – c5% of total activity Continence – c35% of total activity Podiatry – c3% of total activity Respiratory – c3.5% of total activity

Additional information: Due to the urgent and pressing requirement of the CCG to securely transfer these services by the 31st March 2016 to minimise impact to patient care, providers wishing to be considered as a ‘Capable Provider’ for this contract should formally express an interest via In-Tend https://in-tendhost.co.uk/scwcsu/aspx/Home by 12 noon on 15th September 2015. Responses will not be accepted by any other means. For the avoidance of doubt, there will not be any further formal advertisement of this opportunity and therefore interested providers must express an interest by the above deadline to be considered.

The Services are health care services and are therefore Part B services for the purposes of the Public Contracts Regulations 2006 (as amended) ("the 2006 Regulations"). The Public Contracts Regulations 2015 ("the 2015 Regulations") set out transitional arrangements and Regulation 120 of the 2015 Regulations confirms that the 2015 Regulations do not yet apply to the procurement of health care services for the purposes of the NHS within the meaning and scope of the NHS (Procurement, Patient Choice and Competition) (No.2) Regulations 2013) commenced before 18 April 2016.

Consequently, the 2006 Regulations apply to the conduct of the CCG to secure a capable provider of these services. Any assessment process arising out of this Prior Information Notice will be run in accordance with all relevant legislation and guidance as far as it pertains to Part B health care services. For the avoidance of doubt the Commissioner will not be bound by the Public Contracts Regulations 2006, the Treaty on the Functioning of the European Union (TFEU) or any other regulations or legislation except for the specific parts or circumstances that apply directly to the procurement of Part B services. The Commissioner is therefore not bound by many of the formalities and requirements of the 2006 Regulations and reserves the right to vary the form and manner of any capable provider assessment accordingly.
