NHS England and Swindon Clinical Commissioning Group (CCG) are working together under co-commissioning arrangements to procure GP led Primary Medical Care Services across the Swindon area.

The Lead Commissioner for this procurement will be NHS England, represented by NHS England South (South Central).

The CCG’s mission is to optimise the health for the quarter of a million people registered with their 26 GP practices in Swindon and Shrivenham. The CCG is currently split into 3 localities; however, work is underway to look towards moving to six Neighbourhood Groups.

Providers will need to demonstrate experience of implementing innovative change resulting in real benefits for patients and who are able to provide services in such a way as to support delivery of the NHS Five Year Forward View, General Practice Forward View and the Swindon and Shrivenham Primary Care Strategy.

The successful Provider will be expected to provide high quality, cost effective primary medical services which are responsive to the health needs of the population and support continued improvement in health outcomes. In accordance with the Swindon & Shrivenham Clinical Commissioning Group Strategy, the Provider will be expected to use innovative workforce and operational models to deliver a wide range of services in primary care, working in an integrated way with other organisations to improve co-ordination of care. They will take a proactive approach to maintaining health and plan effective care for patients with greater health needs including those with long-term conditions. Over time the Provider may look to develop their service to work with other organisations in new ways, as described in the five Year Forward View.

The procurement is divided into the five (5) Lots below. Bidders may bid for one or more Lots.

Lot 4 requires a bid to be linked to another Lot or from an existing contract holder.

The procurement is being carried out by NHS South, Central & West Commissioning Support Unit (SCWCSU) on behalf of the Commissioner.

Contract length terms are requested for all Lots:

a)Contracts for a maximum term of five (5) years
b)Contracts for an initial term of ten (10) years with a possible extension of any period up to a further 5 years (as defined and at the discretion of the Commissioner).

Any award of contract in excess of five years will be subject to appropriate NHS England business case approval. The Financial Model demonstrates funding for both.

Contract start dates vary for each Lot and are as follows:

The service will be awarded under the Standard Alternative Provider Medical Services (APMS) Contract.

TUPE will apply to the Existing Contracts for Lots 1, 2 and 3.

Providers must have the appropriate Care Quality Commission (CQC) registration and comply with the all other necessary technical, capability and capacity checks as detailed in the Organisational Questionnaire and Specification / Tender documents.

The Services are healthcare services within the meaning and scope of Annex XIV of Directive 2014/24/EU ("the Directive") and Schedule 3 to the Public Contract Regulations 2015 ("the Regulations"). The tendering process will be conducted in accordance with the requirements and flexibilities provided by Articles 74 to 76 of the Directive, and Regulations 74 to 76 of the Regulations. The Authority will run a transparent tender process, treating all bidders equally. For the avoidance of doubt, the Authority will not be bound by the Regulations or the Treaty on the Functioning of the European Union or any other regulations or legislation except for the specific parts or circumstances that apply to the procurement of these Services.

Neither the inclusion of a bidder selection stage, nor the use of any language or terms found in the Directive or Regulations, nor the description of the procedure voluntarily adopted by the Authority ("Open", "Restricted", "Competitive Procedure with Negotiation", "Competitive Dialogue" or any other description), nor any other indication, shall be taken to mean that the Authority intends to hold itself bound by the Directive or Regulations, save by the provisions applicable to services coming within the scope of Annex XIV of the Directive / Schedule 3 of the Regulations. The services are healthcare services falling within Schedule 3 to the Public Contracts Regulations 2015 ("the Regulations") which are not subject to the full regime of the Regulations, but is instead governed by the "Light Touch Regime" contained within Chapter 3, Section 7 of the Regulations (Regulations 74 to 77).
